AN OPEN LETTER TO THE CHIEF JUSTICE OF INDIA
Sir,
A public statement by 272 retired officials condemning the Leader of the Opposition for questioning the Election Commission is not just misplaced — it is a deliberate distraction. Instead of responding to the grave issues raised, an organised campaign has been launched to attack the messenger and shield the Commission from scrutiny.
The danger before us is not criticism of a constitutional body, but the rapid collapse of its credibility. The following facts speak for themselves:
1. The new appointment system for Election Commissioners is structurally rigged — two members aligned to the ruling party and only one representing the opposition. Neutrality becomes impossible by design.
2. The law enabling this structure was pushed through Parliament without debate, after suspending 146 MPs to silence dissent.
3. The same law grants the Election Commission full immunity from judicial review — an unprecedented assault on constitutional accountability.
4. The CEC’s long working relationship with the Home Minister raises unavoidable concerns of conflict of interest.
5. Documented, large-scale errors in electoral rolls — sourced from the EC itself — expose the integrity of the voter list.
6. The EC’s refusal to share full voter roll data with opposition parties suggests intentional opacity.
7. The distribution of ₹10,000 to 1.4 crore women on the eve of elections, with no action by the EC, is a clear indication of partisan bias.
When the electoral referee behaves like a participant, democracy itself is endangered. Under such circumstances, the opposition is left with only two lawful remedies: challenge the law before the Supreme Court, and alert the public.
Sir,
This is not a clash between political parties. This is a struggle to preserve the foundation of the Republic. If the judiciary does not intervene now, India risks slipping into an unaccountable, authoritarian order where elections become rituals without meaning.
The Supreme Court alone stands between constitutional democracy and its erosion. We urge you to act with the urgency this moment demands.
Regards,
A. K. BHATIA
